Domestic Violence – PWDVA Proceedings

Domestic Violence - PWDVA Proceedings

Domestic violence proceedings may arise where a woman alleges violence, abuse, threats, harassment or other conduct falling within the scope of the Protection of Women from Domestic Violence Act, 2005. The Act provides a framework for seeking civil reliefs through the Magistrate, including protection, residence, monetary relief, custody and compensation, along with interim and ex parte orders in appropriate circumstances.

Adv. Dharmendra Chawla & Associates, with its office in Chembur, Mumbai, handles domestic violence proceedings under the Protection of Women from Domestic Violence Act, 2005, including representation of aggrieved persons as well as respondents. The practice represents clients in Mumbai, Navi Mumbai, Thane and other parts of India, depending on the nature of the matter and applicable jurisdiction.

A domestic violence proceeding should be assessed on the basis of the allegations made, the nature of the domestic relationship, the documents and evidence available, the reliefs sought and any connected matrimonial or criminal proceedings. The existence of allegations in a domestic violence application does not by itself determine the final outcome of the proceedings.

Understanding Domestic Violence Proceedings

The Protection of Women from Domestic Violence Act, 2005 provides remedies to an aggrieved woman who alleges domestic violence within a domestic relationship. The Act recognises different forms of domestic violence and provides for specific reliefs depending upon the circumstances of the case.

A proceeding may arise between spouses and, depending upon the statutory requirements and facts, may also involve other persons connected with the domestic relationship.

Domestic violence proceedings are generally initiated before the Magistrate having jurisdiction under the Act. The proceeding may involve interim applications, evidence, responses to allegations and final determination of the reliefs claimed.

Reliefs Available Under the Domestic Violence Act

The Act provides for different forms of relief depending upon the facts and circumstances of the case.

A Magistrate may grant a protection order where the statutory requirements are satisfied. A residence order may also be sought in appropriate circumstances. Section 17 recognises a woman’s right to reside in a shared household, while Section 19 provides for specified forms of residence-related relief.

The court may also consider claims for monetary relief, custody orders and compensation orders under the Act. Interim and ex parte orders may be passed under Section 23 where the circumstances justify such relief.

The nature of relief available depends upon the allegations, evidence, domestic relationship, financial circumstances and other facts placed before the court. A particular relief is not automatically granted merely because an application has been filed.

Right to Residence and Shared Household

Residence-related disputes are an important part of many domestic violence proceedings.

Section 17 of the Act recognises the right of a woman in a domestic relationship to reside in the shared household, irrespective of whether she has a legal or beneficial interest in that property. Section 19 further provides the Magistrate with specific powers concerning residence-related reliefs.

The Supreme Court in Satish Chander Ahuja v. Sneha Ahuja considered the meaning and scope of the expression “shared household” and clarified that the concept cannot be restricted merely to property owned or rented by the husband. The factual circumstances concerning the parties’ residence and domestic relationship remain important in determining whether a particular premises constitutes a shared household.

Accordingly, disputes concerning residence should be examined on the actual living arrangements, nature of the domestic relationship and relevant property circumstances rather than ownership alone.

Evidence in Domestic Violence Proceedings

The evidence required in a domestic violence proceeding depends upon the allegations and reliefs claimed. Depending on the circumstances, relevant material may include medical records, photographs, messages, emails, call records, financial documents, bank statements, rent and household expense records, property documents, complaints made to authorities, correspondence and other documentary or electronic evidence. Where financial relief is claimed, the financial position, income, expenses, assets and liabilities of the parties may become relevant. Where allegations concerning children or residence are involved, documents relating to the children and living arrangements may also assume importance.

The relevance and evidentiary value of a particular document depends upon the facts and the manner in which it is produced before the court. Evidence should therefore be examined as a whole rather than relying upon isolated messages or documents.

Domestic Violence Proceedings and Other Cases

Domestic violence proceedings may exist alongside matrimonial or criminal proceedings arising from the same set of circumstances. For example, a dispute between spouses may involve a proceeding for divorce, a maintenance claim, a complaint under the domestic violence legislation and, depending upon the allegations, separate criminal proceedings.

These proceedings have different statutory requirements and may involve different reliefs. The filing or outcome of one proceeding does not automatically determine the outcome of another. For this reason, where multiple proceedings are pending, the pleadings, allegations, documents and orders in each matter should be considered together before deciding the legal course.

Matrimonial and divorce matters are dealt with separately under the practice’s Matrimonial & Family Law service.

Interim Relief in Domestic Violence Matters

Interim relief can become particularly important where immediate protection, residence, financial assistance or other relief is sought during the pendency of proceedings.

Section 23 of the Domestic Violence Act empowers the Magistrate to grant interim orders and, where the statutory requirements are satisfied, ex parte orders. The circumstances of the case, the material placed before the court and the nature of the relief sought are relevant to such applications.

An interim application should therefore be considered separately from the final determination of the domestic violence allegations. Both the applicant seeking relief and the respondent opposing it may need to address the factual and legal basis of the interim request.
